    Know Your Rights!! Never Consent to a Search!!!

     

    If you are stopped by police officers on the highway or if they are at your door remember that you have rights! They need a warrant or “probable clause” to search your home. If you violate a traffic law or if they have “reasonable suspicion” they may stop your car~ they need a “probable cause” or a warrant. They may try to get you to consent to a search, but ultimately you do no have to consent. They may try to pressure you in many ways. Remember, You do not have to give a reason for not consenting ~ you would rather be on your way, you’re busy, ect. If you do consent to a search it will be a legal search. If you do not consent the police officer must convince the judge in court that he has “probable cause” to believe that you violated the law (not just by the way you look, ect.). They may  still search you without consent. If so, Don’t resist ~ tell it to the judge. The police may tell you they will “go easy” on you if you don’t make them get a warrant ~ remember that the police officer does make the final decision about what you are charged with ~ the prosecutor does that. Any promises they make to you are not binding on them. Try to remain calm, don’t swear or yell. If there are passerby you may ask them to witness that you do not consent to a search. Be sure to keep your hands visible and dont make any quick movements ~it is common for police to claim they thought you had a weapon and that they thought they might be in danger. You present no credible threat if you are standing next to a car with your hands visible. You do not have to answer any questions or even present ID if you are not driving. Always be polite but don’t let them intimidate you. If they threaten to get a warrant~ let them try ~ many officers will not even take the time to get a search warrant. It may take too long and the judge may find you were detained unreasonably. If you are under arrest do not say anything until a lawyer is present.

     

    Notice and remember all detail that you can!! Who the officers were~ get  their badge numbers & be sure you know which  police agency they are from. Try and remember what was exactly said to you, The order in which things happened, ect. Write it down as soon as possible.

     

    Be sure that your vehicle has all of it lights working, that you obey traffic laws, & that your licenses is up to date ~ vehicle violations give police a reason to stop you. The Supreme Court has recently held that a traffic violation does not give the office probable cause to search your vehicle. The Supreme Court also recently held that if the police officer has “probable cause” to believe the driver has committed a law violation he may search the effects~ bags, backpack, ect. ~ of the passengers (under the theory that the driver may have passed his contraband to a passenger).

     

    Also~ Never leave anything in plain sight~ the tiniest paraphernalia in plain sight gives them probable cause to search.

     

    This may seem silly but never put contraband, even scraps, in your curbside garbage. Once you put the garbage at the curb you no longer a reasonable expectation of privacy~ yes, they may search you garbage...

    So be aware and stay smart! but most of all stay high~!

  • smoke signals... episode 2.19.10

    Hey!  It’s time for another smoke signal, so roll that spliff and well…you know what to do!

    Life as we know it is pretty amazing! I am sooo happy to see myself as the homepage image on the Miss Hightimes page.  I remember when I first started Miss Hightimes seeing Miss Susie on the homepage and thinking “Hopefully one day that will be me.” Thank you SO MUCH to everyone who has voted for me so far.  My next step is Miss Hightimes 2010! What an honor it would be!!  I ultimately hope to gain some lifelong friends…. not that I haven’t already! I am already sooo grateful I can only guess what else is in store for me.

    So I’m finally settled into my new place and it feels pretty good.   It’s really crazy how life turns out when you go with the wind.  I have been busy at work creating a genetics list for Boulder Holistic Solutions and it’s been pretty interesting.  We have over 60 different strains so if anyone has any good websites where I could find the proper genetic information I would really appreciate it!

    Sadly, my chinchilla of five years passed away on January 26.   Her name was Tootsi and she was such a good girl. She loved dandelion drops and running on her wheel.   When I would smoke my bong she would always go to the side of the cage so I would blow some her way!  Haha!  She was very special to me and she will always be in my heart.  I buried her on the highest point in Broomfield facing the beautiful mountains. I think she would like that. I also got her a gravestone.  I think it’s really beautiful.

    Thank you to everyone who takes the time to read my blogs.  I know sometimes it’s hard just keeping up with comments on our pages so really it means the world to me.

  • smoke signals.... episode 1.19.10

    Hello Hello, and happy new year!! Another smoke signal is up in the air! So as you all know, feel free to toke it up and read on…

    "How things appear seem to be ever unclear"... especially for me at this point. Life itself can be so unpredictable. A simple dream can take you on a journey that seems unreal at times. Let's just say, I have been working very hard on achieving my ultimate goal, True Freedom.

    I have made a very big decision in my life since my last blog. I am moving into my own apartment at the end of the month. It has not only been one of the toughest decisions of my life, but one of the most life-changing. I have never truly been on my own (I have had roommates for a while) so it feels pretty amazing. I am moving closer to the dispensary where I work. Currently, I drive 45 minutes everyday to and from work. It’s been pretty hard on me and my little purple truck! Good thing it’s a Toyota- hahaha! I am making this decision because I feel in my heart that I am ready to take what all life has to ask for, and take the risk to spread my wings and be on my own. I am ready for a journey of self-exploration, because I have been given so much. It’s my time to shine.

    There are a lot of good things coming for me this new year- I feel it in my bones. I want to take a moment to thank everyone who has supported me throughout the past year. May your 2010 be as amazing and as life-changing as I hope mine will be. I think one thing I will take from 2009 is that anything you dream you can achieve, with hard work and cannabis! Haha!
